WE are an FDIC bank. We are non hmda but I have had someone tell me we have been keeping a "Fair Housing Log" since the beginning of time it seems :), that is actually the one that the OCC has put out. They are saying they get conflicting info. One says we dont have to keep this we are not HMDA and not OCC bank. The other says yes we have to because someone back in 2002 started this and said we must. Examiners have never asked to even look at it. What is the answer???

Wire Automation

Anyone with a good Wire Automation software? We would like to import our Fedline file into the software, have it run OFAC, match with the recepient name on our core (Harland Phoenix), and after approvals, post the wire to the account through an interface. Similarly, with the outgoing wires, I would like for our branch personnel to log-in and enter the wire request, print out a form for the customer's signature, then have the wire room review and approve the wire before exporting the wire file to Fedline. Some of this may be wishful thinking, but if you have found a partner/vendor that is offering most of this, please share the Vendor's name with me.

Recently we have started to evaluate the potential risks involved with this feature, especially if the account is compromised in a corporate account takeover scenario. SOC1, SOC2 Report Tracking & Review

Good Morning-

Does anyone have a way in which they are tracking and revewing the new SOC1 and SOC2 reports that service providers are starting to send in. Maybe even a form that is used to review?

Also, it seems that those organizations that have NPPI are submitting a SOC2 Type 1 and not a SOC2 Type 2, how are you handling this with the service provider if one is not available.

We have a pretty good system going on internally here, but I am struggling with how to monitor of offsite machines we have. It is suggested we inspect and document the machines daily. That’s easy for a machine sitting in the lobby or the drive thru, but not so easy for one that is across town at the hospital.

Refund Policy / Refund Chart

The chart would have the various types such as "NSF Fee" and across the top of the chart would be reasons for possible refund, example "bank error". The corresponding answer when checking the chart with the block in which they intersect would state "yes", meaning a refund of the NSF Fee should be made. Reasons for refund might include "first time OD", small check amount", etc.

These decisions seem quite simple but in many case refunds are made when they should not be and vice cersa. Any rtefunds charts out there?

Service Charge

I was approached by our CFO and asked what we can do about collecting the remainder of a service charge? What she meant is for example a DDA account with 3.00 in it has a service charge come out for 10.00 but since the service charge cant overdraw the account we can only get the 3.00 and lose the 7.00 of income. Now say the same night their is an ACH deposit to go on that account for 700.00, can we now take the 7.00 that was the remainder of the service charge and if we do this are we okay as long as it is spelled out in the account disclosure for example. ANd if so would it only apply to account being opened from now on as they would be the only ones to get the disclosure with that information in it as it is not in there at this point. Whew.....I would appreciate anyones take on this.

Are you preparing now for new CTR and SAR requirements?

At a BSA conference last last year I learned about several changes that will take place when FinCen's new CTR and SAR requirements become mandatory. I remember that one of the things that will be added is the NAICS code. We don't current enter that into our core and I am beginning to worry about how I will provide that. Electronic Benefit Cards

Generally, we do not cash checks of any kind for individuals who are not bank customers.

I now find myself with a new issue since the federal and state government have gone to paying benefits via prepaid cards bearing the VISA or MasterCard Logo. We are experiencing a high volume of Cash Advance requests each time these cards are issued. As I understand our agreement with our vendor we are not allowed to impose a surcharge for a cash advance. I would be interested in knowing how other institutions are handling this issue.

State Tax Levy: Current or Available Balance?

We have received a State Tax Levy for a customer. My question is this: Our system shows pending presentments (a credit or debit is going to be presented that day which won't post to the account until the end of closing for that day), do we take into consideration that those debits or credits should be taken into consideration when figuring the amount that should be paid to the levy if total funds were not available, or do we just take the amount that was in the account as of opening that day?

Addtional Principal Payment option online

Escrow - Initial Deposit & Aggregate Adjustment

When calculating the initial deposit for an escrow account, is the aggregate adjustment on the HUD supposed to be added? We have a loan with insurance ($1,032) payable in November and taxes ($513.60) payable in April. The computation year started in December. I've used the Escrow Verification form on the BOL site, and it's saying the initial deposit should be $257.60, which is the 2 month cushion we selected. The loan assistant added the aggregate adjustment amount from the HUD ($299.60) to make the total initial deposit $557.20. Is this standard practice, and if so, what part of the reg does it pertain to?

Debit Card Fraud

We have recently gone real-time with our debit cards and I was wondering how others handle fraudlent items that are memoposted but have not yet actually cleared the customers account. These items can sit out there for a few days depending on when the originator actually processes the items. I have had a few that have never actually posted to the customers accounts.

Do you go ahead and give the customer credit even though the items hasn't actually cleared, Do you delete the memoposted item and put a stop pay on the system so the item never hits the customer account? I'm just not sure on the best way to handle these items.

Product Info Matrix

Initial Escrow Account Statement - Payment amounts

We recently closed a loan that required an escrow account. For whatever reason, a tax payment did not fall within the initial escrow computation year, so the only disbursement indicated was for insurance. However, the escrow payments were determined using both the insurance amount and the tax amount from the previous year. Is this permissible under the reg, or does this count as pre-accrual? Any help is appreciated. Thanks!

After Hours IT Support Procedures

I am looking for procedures to set a clear understanding of after-hours emergency and contact protocol. Below are two questions for clarification.


1.) If you ran into a problem over a weekend or after normal business hours, what’s the process and the resolution?.. i.e., do you have a toll free number to call, how long do you typically have to wait for a response (if any over a weekend)??

What is your experience with Suntell Square 1 Credit Suite or Web Equity?

We are in the process of comparing Square 1 Credit Suite and Webequity. So far I like the ability of Square 1. It interfaces with our systems (Sparak and Laser Pro) and seems to have a good credit presentation platform. Web Equity has less interface capability and may be more difficult to set up, but it has a more comprehensive ALLLs section. (Square 1 does a FAS 114 analysis on collateral dependent loans only. However, Web Equity assumes all our cash flow dependent impaired loans are on non-accrual.) We have recently become a Q2 online/mobile bank and are going through our first audit. The auditors are asking for a report to show CSR actions per day for our customers. Q2 Central offers a very large report filled with information that does not allow filtering down to 'high risk' actions:
• Change end users password

• Disabling end user
• Adding/deleting end user
• Adding/deleing accounts
• Changing login ID’s
• Changing Secure Access Information
The report gives too much information that is not relevant to the audit and makes viewing cumbersome.

Online Account Opening Statistics

My answer to MGT: 'I don't know'.
But here is what I do know:
1) Our web stat counter tells me that our checking account web pages are averaging about 450 visits per month. This is with no advertising directing people to these pages.
2) Our city population is about 95,000. Mixed demographics.
3) About half of our current customer base is online savvy.

So here is my 100 point question(s):

I noticed in our Bankers Systems forms library that there is an Electronic Signature Consent form that requires the customer to agree to have his/her signature electronically applied to all documents and lists those documents.

I have a few questions: do other FIs use this? If so, what do you do if a customer comes in and electronically signs another document (say a simple form like an Account Change or CD Redemption form)? Do you require the customer to sign the Esign Consent Form every time the signature pad is used, or is it only important when opening a new account to document the customer's acceptance of all of the terms and conditions associated with new account disclosures.

Also, do you use a second computer screen at the desk to allow the customer to see the documents that are being electronically signed, or do you have another method?

With the current “White Plastic” debit card fraud, I need a refresher on debit card liability limits in giving provisional credit to customers.

Reg E speaks to “If the consumer notifies the financial institution within two business days after learning of the loss or theft of the access device, the consumer's liability shall not exceed the lesser of $50 or the amount of unauthorized transfers that occur before notice to the financial institution…"

The customer has possession of the card,it is not lost or stolen. How is your institution handling these losses. We are finding that the "white plastic" card is swiped and a receipt is generated which the fraudster signs. We are unable to file an unauthorized debit card transaction through our processor because the "card" was present at purchase. We are taking the losses.

Durbin Admendment requirement for routing network exclusivity

The Durbin Amendment concerning interchange caps allow financial institutions of $10 billion or less to be exempt from the cap. However, we are still required to have available 2 unaffiliated networks to prevent exclusivity of routing for our cards. We currently have a separate PIN and signature based network, however I am being told that if I offer PIN only ( ATM) cards that I will need to carve out an additional PIN network to allow for that type of card.
Any thoughts how anyone else is handling this issue.

Reg Q Repeal - Affects NOW Account Eligibility?

As of July 21, can NOW accounts be granted to for-profit corporations, partnerships and others with tax statuses that were previously excluded? I saw an examiner's opinion on a post somewhere: "As a result of these changes, there are no more NOW account eligibility restrictions."

But if so, then a bank could not deny a NOW account for the previously-valid reasons, correct? Yet if bank is not prepared to start paying interest to commercial demand deposits, then bank would have to deny the NOW on the basis of the decision not to pay interest; the previous restrictions would no longer apply.

Our RDC Customer Agreement is very detailed as to what our customer's responsibilities will be to ensure information security. However, upon conducting our annual on-site inspection, we are finding that many customer's are not complying with the agreement with regards to record & document retention.
My question is: What consequences should we implement if this problem (or others) isn't corrected?
Repeated non-compliance is definately cause for termination of the service, but at what point do we refuse to accept the risk? We want to keep our customers, but also want to conduct due diligence for the safety of our customers and their customers as well.

Since we pay fees per user, we have a process for deleting online subscribers after 120 days of inactivity. Before we delete them, we send an e-mail to each subscriber after 90 days of inactivity, to let them know they are pending deletion and inviting feedback as to why they don't use it. What method do you use to tie account to e-banking logins?

We manually relate any and all accounts to all login ID's, which as you can guess can be a lot of work. Our issue was this: Upon initial launch of the product, all accounts were tied to the login ID automatically with the Customer Information File, based on the customer's social. Soon after, due to customer complaints, management decided to allow multiple applicants access to the same login ID (ie: husband and wife could use one login instead of having two separate ones). This meant we could only tie accounts manually per login ID after verifying both applicants were on all accouts listed, as many times one applicant would not be on all the accounts the other was. Indeed, some had accounts the other applicant wasn't even aware of.

It was not so long ago that we could rely on our account signature card contracts for direction on the bank's rights to close out account(s) and/or account relationships. It was all about safety and protecting the bank and investors. Not so much today.

Deceased Depositor Accounts - How do you manage them?

Currently, since FiServ only offers the ability to print 1099 year-end statements based on the Tax ID at the end of the year, it makes it impossible to make changes to an account mid-year if it has tax implications. If a customer has a joint account and his spouse dies, he comes in to remove her name with proper documentation, etc. But if she was the tax link on the account and we process a W-9 change, we could be impacting the tax situation for both the surviving spouse and the estate of the deceased. Any other FiServ banks have a suggestion on how to work this? My previous bank had proprietary information systems and was able to manage the split without issue.

We are required to have our Originators send in a verification transmittal for each ACH file they send in. We've recently had an ACH Originator start using the recurring feature for single receipt transactions. Because of this, they don't send in a transmittal because they aren't 'aware' of the transaction being submitted. Does anyone else have client's using this feature? How do you handle your tracking logs and present to auditors if you don't require the transmittal? Also, do you require transmittal, or any kind of, verification on External Transfers?

ACH Exposure

How does your bank recognize and approve limits for ACH Exposure? Once approved, how do you monitor and track the exposure. Since technically it is not considered debt when calculating legal lending limits for borrowers, but the exposure does need to be monitored, how is it handled? Do you set up a product on your system and load it? Do you treat it as an "internal commitment" that can be canceled at any time? We currently use ITI Navigator system and I am trying to configure a way to monitor it through the system so that we can get an accurate idea of what our exposure is to each borrower. Any help would be appreciated!

Dealer Float Lines

This is in regards to dealer float lines for the purpose of providing immediate credit on outgoing drafts. Our bank goes through the normal approval process for a maximum amount of immediate credit allowed at any one time. My question is: How do you reflect this on your system? Do you show it as a commitment on your system? Do you have them sign a promissory note and/or what type of agreement do you have them execute? How do you monitor the activity? TEchnically it is not a loan until such time as they do not fulfill their obligation and are unable to cover the charge back to their account in the event the draft is returned unpaid. Any help on how others handle this situation or procedures would be very helpful!

Annual Escrow Analysis

Escrow accounts are fairly new to our institution. We recently had a customer that received notification from the tax assessor that his real estate was reappriased and that his taxes would be increasing about $12 a year. We performed the annual escrow analysis a month ago and used the older tax amount. Are we allowed under the regulations to change his escrow payments now? If so, do we still have to provide 45 days notice as with the annual disclosure?

Calculating past due loan reports

Our core loan system calculates past dues based on exact number of days and not calendar days (i.e. 31 day month). The system counts the payment due date as the first past due day if the payment is not paid on the due date. This can cause loans to be 30 days past due within the same month in months having 31 days. How does your bank gather information for 30-89 days past due loans? We are looking for a way to resolve this. Can you help?

2nd lien Home Improvement loan
